Partner Visa (Offshore): Subclass 309 and 100

The offshore Partner Visa (Subclass 309 / 100) is for people outside Australia who want to join their Australian partner. Like the onshore pathway, it's a two-stage process: first, the temporary 309, then the permanent 100. The offshore pathway is often chosen when the applicant is still living overseas or when the 820 onshore pathway is not available.

Who is This Visa For?

Partners or spouses of Australian citizens, PRs, or eligible New Zealand citizens who are living outside Australia and wish to migrate to be with their partner. Can apply from any country.

Visa Conditions and Key Details

β€’  309 (Temporary): Allows entry to Australia; unlimited work and study rights

β€’   100 (Permanent): Granted 2 years after 309 lodgement if the relationship ongoing

β€’   No Bridging Visa A required; 309 itself allows travel

β€’   Can travel freely in and out of Australia on 309

β€’   100 grant = full PR status

Processing Time and Cost

β€’   Processing Time: 309: 75% within 23 months; 90% within 36 months

β€’  Visa Application Charge: AUD 8,850 (2024–25), same charge as onshore pathway
